On 4/29/2018, I received a phone from Sgt. Baron from Tucker precinct. She stated that she was at the Stone Mountain Inn with the sister of the suspect who was arrested for aggravated stalking the previous date. Sgt. Baron advised me that the sister was attempting to allege that Sgt. Harmon and I had used force in taking the subject into custody. I advised Sgt. Baron that was not true and explained the incident to her over the phone (see original report). I further explained to Sgt. Baron that the reason the suspect was arrested was due to the fact he had the outstanding warrant. I also explained the reason an arrest was not made in reference to any type of assault was based on the following:
- The subject arrested (Ivory Rucker) stated to me three different times that he was not involved in a physical altercation or assaulted by anyone at the Stone Mountain Inn.
- Both individuals that were questioned (Jarvaris Byrd and Sidney Kendrick) both stated that they had not attacked or gotten physical with Mr. Rucker.
- There was no visible injuries to Mr. Rucker at the scene.
- I was advised that I was unable to view the cameras by an employee at the time
- There was no independent witnesses or any other evidence at the scene to suggest Mr. Rucker was victim of any crime. Sgt. Baron called me about an hour later and advised she was able to view the tape and it appeared that Mr. Rucker was assaulted by the two subjects.
On 4/30/2018 I advised my supervisors of the conversation that I had with Sgt. Baron and was advised to go see if the management was able to make a copy of the video. Around 1508 hours, I responded to 1819 Mountain Industrial Blvd with Sgt. Harmon and met with management of the Stone Mountain Inn. They made several attempts to make a copy of the video on both a disk and usb drive, but were unable to save the video to their computer or devices. I recorded the first ten minutes of the incident on my county cellphone. In the video I observed, it does appear that both Javaris Byrd and Sidney Kendrick were kicking Mr. Rucker. Shortly after reviewing the video, I contacted Major Felony Detective McQuilkin of the situation and turned the case over to CID.
